McLaughlin & Stern Achieves Complete Dismissal in Quiet Title Action

Garden City, NY – October 7, 2024 – McLaughlin & Stern LLP is pleased to announce a decisive win for a homeowner client in a quiet title action, successfully defending against claims of breach of fiduciary duty, fraud, and conversion. The dismissal was secured by Garden City-based partners Justin M. Piccione and Dennis Wiley, with support from paralegal Jessica Ridout.

New York State Supreme Court Justice Randy Sue Marber issued the decision, which fully adopted the arguments presented by Mr. Piccione and Mr. Wiley. The Court determined that the plaintiff lacked standing due to speculative claims and an absence of an injury-in-fact necessary to establish legal standing. In addition to the dismissal, the Court granted McLaughlin & Stern’s application to cancel the Notice of Pendency that had been in place since the beginning of the action.
