Brickman and Gallaway Win Multimillion Dollar Judgment

John Brickman and Brett Gallaway, partners in the firm’s litigation department, have won an appeal, affirming a million-dollar-plus judgment they obtained for clients whose upper East Side duplex penthouse apartment was rendered uninhabitable by persistent water leaks of more than a decade.

In the case, which Brickman and Gallaway tried, the Supreme Court, New York County, awarded the firm’s clients more than $1.4 million, with an additional upcoming award of their attorneys’ fees.  The damages followed from the cooperative apartment building’s failure to correct repeated water leaks, which required the plaintiffs to live outside their apartment for more than 1,200 days, and precluded their use of half of the apartment for an additional 900 days.  The Appellate Division, First Department, affirmed the building’s liability and set the damages amount.
