Grieco and Brickman Win Dismissal of Bank’s Mortgage Under the Statute of Limitations

In a case handled by Brian Grieco and John Brickman, on December 18, 2018, the Supreme Court, New York County, ruled in favor of our client, dismissing a bank’s foreclosure action as barred by the statute of limitations. The client had purchased valuable real estate – subject to a bank’s mortgage – and sought to discharge the mortgage because the bank had allowed the statute of limitations to run. The Supreme Court rejected all of the bank’s arguments and ruled in the client’s favor. The Court entered judgment in favor of the client, dismissing the action and discharging the mortgage as null and void. The case is titled U.S. Bank Trust, N.A., as Trustee for LSF8 Master Participation Trust v. Ngo, et al., Index No. 850227/2017.
